Rent indexation in Belgium
The legal formula is rent × (new health index / health index of the month preceding signature).
Important rules
- •Not automatic: indexation is only due if the landlord makes a written request. No request = no indexation.
- •Once a year: on the lease anniversary date (e.g. lease signed in June 2024 → indexable each June).
- •EPC mandatory (Brussels, Wallonia): in Wallonia and Brussels, indexation is capped or excluded for properties with poor energy performance (EPC E, F, G).
- •Limited retroactivity: the landlord can claim indexation with a maximum 3-month retroactivity. Beyond, the right is lost.
